Terms of Service

    The terms and conditions governing your use of Taggian services.

    Effective Date: 20-07-2025

    1. Definitions

    Taggian: The commercial name of FrontLetter BV, registered at Blankenbergse Steenweg 287, 8000 Bruges, Belgium.

    Client: The natural or legal person who registers for or uses Taggian's services.

    Services: The hosting and management of Google Server Tag containers and related infrastructure provided by Taggian.

    Platform: The Taggian web application at https://console.taggian.io.

    Website: The informational site at https://taggian.io.

    Container: A server-side tag container hosted and maintained by Taggian on behalf of the Client.

    FUP: Fair Use Policy – non-metered use within reasonable operational limits.

    Access Credentials: User credentials for logging into the Platform.

    Agreement: The agreement between Taggian and the Client, including these Terms.

    2. Scope and Acceptance

    2.1 These Terms apply to all use of the Services.

    2.2 By registering or using the Platform, the Client agrees to be bound by these Terms.

    2.3 Taggian may revise the Terms at any time. Continued use implies acceptance of the updated Terms.

    3. Trial Terms

    3.1 New Clients receive a one-time free trial for 7 consecutive days, limited to one container.

    3.2 To continue beyond the trial or lift usage restrictions, the Client must add a valid payment method.

    3.3 The trial ends automatically after 7 days.

    3.4 Taggian may change or withdraw trial offers at any time.

    4. Services and Availability

    4.1 Taggian provides European-hosted infrastructure for server-side tag containers.

    4.2 While high availability is a goal, no guarantee of uninterrupted service is given.

    4.3 A European CDN is used to optimize delivery.

    4.4 Taggian may change or upgrade the Platform without prior notice.

    5. Fair Use Policy (FUP)

    5.1 Services are not metered per request but are subject to a Fair Use Policy to ensure platform integrity.

    5.2 Excessive usage may result in rate-limiting, suspension, or the requirement to upgrade to a higher tier.

    5.3 Clients must avoid usage patterns that degrade service for others.

    5.4 FUP thresholds may be adjusted without prior notice.

    6. Usage Limits

    6.1 Taggian limits the number of containers that can be hosted per account.

    6.2 The current limit is enforced automatically by the Platform.

    6.3 Clients may request a higher limit by emailing support@taggian.io. Approval is at Taggian's discretion.

    7. Pricing and Payment

    7.1 Taggian operates on a pay-as-you-go basis, billing Clients per active container per day.

    7.2 No prepayment is required.

    7.3 If a payment fails, all containers may be suspended until payment is received.

    7.4 Prices are listed in EUR and exclude VAT and applicable taxes.

    8. Account and Access

    8.1 Clients are responsible for protecting their access credentials.

    8.2 Unauthorized use must be reported immediately.

    8.3 Taggian is not liable for misuse resulting from negligence by the Client.

    9. Acceptable Use

    9.1 Clients may not use the Platform for:

    • Illegal, abusive, or harmful purposes;
    • Hosting malware, phishing, or spam;
    • Attempting to access or interfere with other systems;
    • Reselling or sharing access without permission.

    9.2 Taggian may suspend or terminate accounts for violations.

    9.3 Automated monitoring may be used to detect abuse.

    9.4 Reinstatement is at Taggian's discretion.

    10. Data Protection

    10.1 Taggian complies with the GDPR and other relevant EU privacy laws.

    10.2 Data is processed only within the EU and never shared without legal basis.

    10.3 Clients remain data controllers; Taggian acts as data processor where applicable.

    10.4 Security measures include encryption, access control, and system monitoring.

    10.5 A separate Data Processing Agreement (DPA) applies when required.

    10.6 Clients are responsible for ensuring lawful processing of any personal data.

    11. Intellectual Property Rights and Licensing

    11.1 All intellectual property related to the Platform, software, and content remains the sole property of FrontLetter BV or its licensors.

    11.2 Clients receive a non-exclusive, non-transferable, revocable license to use the Services as intended.

    11.3 Clients may not:

    • Reverse-engineer, resell, or sublicense the Platform,
    • Remove branding or disclaimers,
    • Bypass technical restrictions.

    11.4 Suggestions or feedback may be used by Taggian freely.

    11.5 All rights not explicitly granted are reserved.

    12. Liability and Indemnification

    12.1 Services are provided "as is" without guarantees or warranties.

    12.2 Taggian's liability is capped at the amount paid by the Client in the 3 months before the incident, up to €10,000.

    12.3 Taggian is not liable for indirect, incidental, or consequential damages.

    12.4 The Client agrees to indemnify Taggian against claims related to misuse or illegal use of the Services.

    13. Client Data and Retention

    13.1 Clients retain full ownership of their submitted data.

    13.2 Taggian processes data only to provide the Service or comply with legal obligations.

    13.3 No data export is provided. Clients are responsible for backing up their data before account termination.

    13.4 Data is permanently deleted within 30 days after termination unless otherwise legally required.

    14. Support

    14.1 Technical support is available via email: support@taggian.io.

    14.2 Response times may vary based on urgency and request complexity.

    15. Duration and Termination

    15.1 The Agreement begins upon first use or registration and continues until terminated.

    15.2 The Client may terminate at any time by ceasing use and clearing outstanding balances.

    15.3 Taggian may suspend or terminate the Agreement immediately for:

    • Non-payment,
    • Abuse or FUP violation,
    • Legal enforcement,
    • Service discontinuation.

    15.4 Upon termination:

    • All access will be revoked,
    • Containers will be stopped,
    • Data will be deleted within 30 days.

    15.5 No data recovery or export is offered after termination.

    15.6 Sections related to IP, liability, data, and payment obligations survive termination.

    16. Governing Law

    16.1 These Terms are governed by Belgian law.

    16.2 All disputes shall be exclusively handled by the courts of Bruges, Belgium.
